ليس للغير حق الرجوع إلا على الشريك الذي تعامل معه. وإذا صدر من الشركاء عمل يكشف للغير عن وجود الشركة، جاز اعتبارها بالنسبة إليه شركة تضامن واقعية، وذلك دون إخلال بسريان شروط عقد الشركة فيما بين الشركاء.
